1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Zoluko Web LLC ("Company," "we," "us," or "our"), governing your access to and use of our websites, products, and services operating under the Smart Stack Method brand.

By accessing or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

Some of our services require account registration. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately if you discover any security breaches related to your account

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Transmit any harmful, threatening, abusive, or harassing content
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt our services or servers
• Use automated systems or bots to access our services without permission
• Scrape, data mine, or extract data from our services without authorization
• Resell or redistribute our services without a valid license

5. Intellectual Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Zoluko Web LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our services without our written permission.

Our services may integrate with third-party platforms and services, including but not limited to:

• LinkedIn (for contact data enrichment)
• Google services (Analytics, Search Console)
• Payment processors (Stripe)
• CRM platforms (Go High Level, Salesforce, HubSpot)

Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the actions or policies of third-party services.

7. LinkedIn Data Enrichment Terms

Our contact enrichment services utilize LinkedIn's Member Data Portability APIs. By using these features, you agree to the following:

7.1 Your Responsibilities

• You will only submit contact data that you have lawfully collected and have the right to process
• You will not use enriched data for spam, harassment, or any unlawful purpose
• You will comply with all applicable data protection laws (GDPR, CCPA, etc.) regarding the contacts you enrich
• You acknowledge that LinkedIn data is provided for your internal business purposes only

7.2 Data Usage Restrictions

• LinkedIn-enriched data may not be resold, sublicensed, or redistributed to third parties
• You may not use LinkedIn data to build competing databases or services
• You may not scrape, cache, or store LinkedIn data beyond what is necessary for the enrichment service
• You must honor opt-out requests from individuals whose data has been enriched

7.3 Compliance with LinkedIn Terms

Your use of LinkedIn data through our services is subject to LinkedIn's API Terms of Use and Privacy Policy. We reserve the right to suspend or terminate access to enrichment features if you violate these terms or LinkedIn's policies.

8. Payment Terms

8.1 Subscription Services

Some of our products are offered on a subscription basis. By subscribing, you agree to:

• Pay all applicable fees as they become due
• Automatic renewal of your subscription unless cancelled before the renewal date
• Provide valid payment information and keep it up to date

8.2 Refunds

Refund policies vary by product. Generally:

• Annual subscriptions may be eligible for pro-rated refunds within 30 days
• Monthly subscriptions are non-refundable after processing
• One-time purchases may be refundable within 14 days if services have not been rendered

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZOLUKO WEB LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) our services
• Any conduct or content of any third party on our services
• Any content obtained from our services
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months prior to the claim.

10. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, secure, or error-free, or that any defects will be corrected.

11. Indemnification

You agree to defend, indemnify, and hold harmless Zoluko Web LLC, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit through our services

12. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use our services will cease immediately. If you wish to terminate your account, you may do so by contacting us or using the account settings in the applicable product.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date."

Your continued use of our services after any such changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved in the state or federal courts located in Maricopa County, Arizona.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
